About the Paper
The topic is an innovative socio-economic history of tort law in Canada in the fifty years after 1945. It stems form a book in progress by Professor Kostal and Erika Chamberlain, intended to illuminate the extremely consequential exchange between socio-economic and legal spheres in this period - and how that exchange was manifested in the genesis, litigation and adjudication of tort claims.
A first article in respect of this project was published in 2023 - Rande Kostal & Erika Chamberlain, The Reinvention of Canadian Tort Law, 1945–95: JordanHouse as Case Study, (2023) 73(2) University of Toronto Law Journal, 133-173.
